Well, preseason is for the children, but it's also kind of for the diehard fans who get into the weeds. Like tonight, you know, for the Chargers, the battle at left guard. You know, it's not for the people who turn out to watch Justin Herbert throw bombs to Ladd McConkey. That's not the crowd for preseason. But, I mean, if you want to get into the weeds, if you're a fan that does, preseason can be very entertaining. You are. I will just say this. Yeah. Yes, I am live from Houston from what I thought was NRG Stadium but is now Reliant Stadium. It's Reliant. Yeah. But I put in NRG in the Uber to get here and it quickly informed me that it was Reliant, so that was good. But, yeah, so, you know, it's the first trip of the season, and I forgot some things. I realized when I got to the team facility and Elsa Gundo on the bus that I had forgotten headphones, that is dumb. That is a dumb thing. Because when you travel these days, you're wearing headphones all the time. Whether it's music, the shows you're watching, it's a long flight. It's, you know, three and a half hours of a flight. There's a lot of bus travel. Like, forgetting your headphones is pretty dumb, dumb. So I did that. Luckily, Matt Money Smith had an extra set because of course he did. He's a Boy Scout and he's prepared for everything. What Matt did not have an extra of is the second thing I realized I forgot when I got to my room and that was a bra. If he did though, if he did, would that be something that you would take from him? I told him, if you did have a spare bra, I don't want to know about it, is what I said to him. Ah, good point. So you had some late night shopping to do. Is that what you're saying? So I went to the Target and I acquired a – well, because – and here's the thing. I have a sports bra, right? It's what I wore on the plane. You can wear workout gear on the plane. It's not a big thing. But we had a broadcast dinner last night with all the broadcast, you know, the TV and radio teams with the Spanos family, and we're going to dinner. so I couldn't wear a sports bra at dinner, you know, so that's the whole issue. So I went to Target and anyway, great dinner. I got to sit next to Dan Fouts, which is always a treat. Wow. He is the best. He is like,

He has such a throwback, like, dry wit about him. I was laughing the entire time. He was telling me about his daughter's wedding recently in Paso Robles. He said it was beautiful. He told me the vineyard it was at. He said, there was a nice pond. I said, were there any ducks in the pond? And he says, I think there was a swan or two. I said, that's nice. It'd be nice to have some waterfowl. And he looks at me and he raises his hands and he goes, well, I'm a duck. And I said, yeah, you are a duck, Dan. You are. Norgon duck. I'm a duck. That's kind of why I asked the question. He wasn't doing the notebook or anything? If I'm a duck, you're a duck? No, he's not ridiculous like other people. Okay, just making sure. And it wasn't, was it a duck in that movie or was it a bird? It's a bird, but that's why it's funny to me because I always say it was a duck because they're in the middle of rainstorm or whatever. I don't even remember. You know what my favorite story about, I think it was ducks involves your wife at Disneyland. That is the best story ever. This, I'll, well, I'll tell you the duck story when we come back because it is. Thank you for a monument. It is so good. It is a really great story because it's so not. There's so many things that go into the story to make it funny. She's going to hate it. I'm going to be in so much trouble. I think she's leaving town. It's so good, though. But it is good. I think the reason it's so good is because your wife is so smart. Right. And sometimes the smartest people say the dumbest S. And this is a perfect example. And I tell her that. Every time we tell the story to something. I have to remind her, the only reason it's funny is because you are as brilliant as you are. Exactly. Exactly. Okay, so there's some headlines, some stuff that's going on. The White House Press Secretary, Karoline Leavitt, is out. The president made the announcement last night. She then came and put a long statement on... Truth Social and on Twitter, et cetera. She wants to spend time with her family. She's a young mother. She's 28 years old. By far the youngest person to ever hold the job of Chief White House Press Secretary. She just had a kid a couple months ago. It's such a hard job. It's such a high-stressed job. No one ever really lasts that long in it. Yeah. So that's going on. The president says we, the United States, are in control of the Strait of Hormuz. Iran says Iran is in control. There's that. We have a new poll for the governor's race here in California. The whole Nick Reiner's story changed significant. Well, it changed a bit yesterday. And we'll talk more about that at the top of the hour. One last thing I forgot to tell you that I forgot. Yes. And I feel awful about it. I forgot cash. So I was a Gary Hoffman and did not tip the maid at the hotel. Whoa. Ouch. I know. I know. Well, no, I only say that because you didn't know the rule for so long. Now you do know the rule and now you do tip. Oh, I guess I was thinking, well, why couldn't you just get some cash and go tonight? But you're not going back to the hotel.

They are taking on the Houston Texans there in Houston, 5 o'clock tonight. It's one of six NFL pregame, sorry, NFL preseason games tonight. They'll start the process, I believe, at 4 o'clock, but the Chargers kickoff is at 5 o'clock tonight. There is a developing story out of New York. It looks like Luigi Mangione is going to be pleading guilty in the federal case against him in connection to the 2024 killing of United Healthcare CEO Brian Thompson in Manhattan.

These are stalking charges resulting in the death of that executive in 2024. He is scheduled to go on trial in about a month in a separate murder case in New York State court for that same murder. Yeah, and it's not clear. Life in prison for these stalking charges, by the way. They're talking about what this is going to mean for the state charges. And I've seen this morning there were some whiffs of this going on. So they were bringing on, of course, legal analysts and very differing opinions about what this means for the state court, state case. Usually the state prosecutors still want to go on with their case. Oh, yeah. They want to make their case in their court. regardless if this guy's going to get life in prison from the federal charges, they want to make their case as well. They want their own justice. But they said there's a specific thing about New York law that could bar a state prosecution for the same conduct. Now, it's not the same charge. Like you said, this would be the stalking charges, and it's not the murder charge that is filed against him in the state court. But there may be some issue there. Right. In state court, he's charged with several counts, including second-degree murder. That could also lead to a possible sentence of 25 years to life. His lawyers will argue today, like you were saying, under New York's double jeopardy law, that state prosecutors may not try him for murder because the state charges stem from the same criminal act as the federal case. However... the DA there will or could counter that the state murder case addresses a different harm than the federal stocking case and it should be therefore be allowed to proceed to trial. So if you're into legal arguments, this would be a fun one to watch this back and forth in the courtroom today. With all... deference to my wife. I mean, not that he would be there. The DA would not be there. But you know what I mean? It'll be a fun legal argument to watch play out. Um, yeah. All deference to my wife story. This story about the duck. Uh, my wife and I, and I actually believe this took place before we were married, but we had traveled with my family. This would be my mom and dad, uh, sisters and their husbands and whatever kids were available at the time, uh, to Disneyland. living in Northern California at the time. And we were at Disneyland. We're on the rivers of America. We're on the big queen, whatever she is, steamboat paddle wheel. And we're going through standing on the very top deck. And my wife and I and my father are leaning over that top deck, just enjoying the nice, warm, beautiful Disneyland day. And there's a point where there's a... kind of an elaborate waterfall and it's two or three levels that come down and there's birds every there's ducks everywhere including at the top of the waterfall and my wife says out loud how did that duck get up there and it didn't take i mean she didn't finish the sentence before she knew

That ducks can fly, obviously. Right. But in the moment, it was such a great. And my dad and I, I think we looked at each other before we looked at her. Yeah. And then she immediately was like, never mind. Stop. Don't even ask why I ask that stupid question. I know how the duck got up there. But it was just that. I know how ducks work. I know how ducks work. But it was just that moment that the smartest people in the world every once in a while say things out loud that, you know, you don't need to say out loud. Yeah, if I said that to my husband, there would be no reaction. It would just be another dumb thing I said 7,500 times a day. There would not be, nobody would bat an eye. It would be, well, ducks fly, Shannon, and then everyone would move on with their day. But somebody smart says that. It's remarkable. It is a fun. Anyway, that's one of those good fun stories. Hey, we did yesterday, you didn't get a chance to talk to us about Francesca Hong. She lost that Wisconsin governor's primary for the Democrats. But remember, on Tuesday, we were talking about the polls, the most recent polls in that case where she was up by 18 or 20 points in the polls. Yeah, I listened to the show yesterday when I was driving and listening to you talk about it. And first of all, great show. You do a really good show. Stop. Second of all, you and Nate Silver are right. You know, I think that we went through this after Trump won in 2016, where the polls were wrong. I don't remember what they were like in the primary season, but for the general election, they were way off. I kind of had the mindset after that one, well, I'm not listening to these polls anymore. I'm not listening to them ever again. And then you kind of get lulled back into this false sense of polls will give you a direction of where the voters are coming from and where they're leaning. And now it feels like at least in the primary season, like you were talking about yesterday that Nate Silver said it's harder in the primary season to predict the polling. And I couldn't really figure out why that is. Well, there is something that's going on. We'll talk about it on the backside of this, but now that we're a couple of days past the actual election, we see the actual turnout, the actual numbers. There are some things that we can conclude about how the polling got it wrong. Now, the question is, are these polling companies going to change the process? They know certain things about the electorate. And it's almost like... I think of it almost like the flu vaccine. You know that the thing is changing. You know that the flu virus is changing. So you're trying to, as best you can, formulate a flu vaccine that's going to protect you against the latest strain. And it seems like pollsters have to do this.

Is it changing just because of the way polls are taken now and how we consume information and how we give feedback in terms of where our thought process is? One of my good friends used to work for Nielsen. Now she works for another company that really digs into where consumer sentiment is at for a specific product or a brand or what have you. It seems like it has... been an emerging science figuring out what people think about a particular in this case candidate the way you didn't have to before you everyone was on the phone you just pick up and say who are you going to vote for or exit polls or all of these things it's it's completely different now yeah we'll talk more about it when we come back you're listening to gary and shannon on demand from kfi am 640 Top of the hour, we're going to talk about the Nick Reiner case and how it changed yesterday with his grand jury indictment, potentially putting the death penalty on the table. But it's California. We know the whole situation here. There are three executions planned today in other states around the country. Tennessee, Alabama, Oklahoma, each scheduled to execute prisoners today. First time that has happened. First time there's three scheduled executions, I think, 16 years. Something like that. So. So we were talking about Francesca Hong and what was considered an upset loss in Wisconsin's Democratic governor's race there. A second straight week that a progressive Democrats double-digit polling lead evaporated on election night. Remember, Abdul El-Sayed, it was supposed to be a landslide. And he won very slimly. You know, it was what, 3%, something like that? One point. It was one point. One point. Very slim margin there. So there's something about progressive votes being overrepresented in polls. And why is that? Yeah. Now, specifically this Wisconsin Democratic primary had some other things going on as well where you had two candidates who actually dropped out. There were scandals that popped up. And the guy who did win David Crowley. did actually drop out of the race at one point, but got back into it to try to take her out because the governor basically asked him to get back into this. The last week of the campaign was dominated by negative coverage of Francesca Hong and her comments about Thanksgiving and football and whatever. It was an absolute mess. But even with all of that going on, the polls got it so wrong. And one of the issues that they're saying now that they're looking at it is that the younger people...

who were answering these polls were basically faking their enthusiasm about it, that they liked Francesca Hong because, or at least said that they supported Francesca Hong because of her policies. But that's very different than saying, and I'm willing to go to the polls on Election Day and actually cast my vote for her. I wonder if this is by design to... over hype a candidate in the polls if that will result in more turnout for that candidate. Like if more people see a groundswell behind Francesca Hong that more people would be like, oh, there's something going on here. I should pay attention to her. Look at how good she's doing in the polls. Maybe it's somebody that I should get involved with or I should, you know, I should pay more attention to. Well, I think there is something. I wonder if it's by design to juice up your polling numbers. There is something to that. That you want to be on the winning team. regardless of what you're doing. So therefore, you might pay more attention to Francesca Hong that you wouldn't otherwise do. There's also an attitude or a question of, would if you were David Crowley, would you want to overrepresent how big the margin is so that people go, oh, she's got this in the bag. It's okay if I don't go vote. Now, I don't think Crowley's people were playing that level of calculus if he dropped out of the race and then got back into it. Well, and the argument against that also, the argument against what I was saying is his own poll. showed that he was down by 20 points or something like that. I mean, that would be an awful internal poll to release if it, uh, if your whole scheme was to try to show how great she was or how overhyped she might have been. I mean, there's, they have to figure this out. The pollsters, like I said, have got to figure out a way to stop overrepresenting the people who don't vote. And I don't know how. I remember studying polls in college, how they do them, how they set them up, the importance of the specifics of the questioning, the importance of who's paying for the poll. I mean, all of those things go into us and how we look at the results from each of these polls, but they've got to figure out a way to be more accurate than just... You know, taking money from one candidate or the other, taking money, sorry, from one network or the other. And there's got to be a science. There's got to be more aggressive science. There's got to wait. You've got to weigh them differently.

Luigi Mangione expected to plead guilty tomorrow to the federal charges in connection with the 2024 killing of Brian Thompson, the United Healthcare CEO back in Manhattan. The idea to or the change in the plea comes less than a month before he is scheduled to go on trial in the state murder case. in connection with the death of Thompson. The federal charges relate to, I think it's two counts of stalking. We don't yet know if he would plead guilty to one or both, and exactly how it would play out with the impact potentially on the state murder case that everybody's looking at. Well, you and I... You first. I was just going to say, if you're a person who is rarely impressed, or if you're a person who is always impressed, I recommend for both of you to go to Big Sur, to drive from Monterey to Big Sur. If you like video games, if you like CGI, drive from Monterey South to Big Sur, where around every bandit's, oh my God, is this real? It feels like that. It is beautiful. It is glorious. It is why California is so expensive. And if you haven't experienced it, it took me a long time living in California to make that drive to experience that way too long. I'm embarrassed to say how long it took. But it is gorgeous. And it is rugged coastline. And as Mother Nature will do, havoc is reek on... rugged coastline like that and that has been the problem with big sir i mean that highway one has been was closed for what three years because of the rains yeah uh the And now they're dealing with what they're calling the timber fire. As of this morning, it's up over 4,200 acres. If you know much about Big Sur, there's the one, there's like Dietgen's restaurant, Nepenthe, I think is how you say it. Nepente. Nepente, I like that better. Henry Miller Memorial Library right there along. If you know where that section is, that is between Julia Pfeiffer, Byrne State Park and the actual. town, I guess you could say a big sir. That's where this fire is. It is burning out of control for the most part, only 7% containment. But when you combine the problems, like you said, of the road having been closed in that same area for almost three years, and now it's closed again. There's a 10-mile stretch that's closed because of the fire. It's not going to get... The quote I saw this morning, which I thought summed it up very well, was... It's hard to be in Big Sur. Right. Especially, you're just, you're cut off if you live there. I mean, I don't think it's ever hard to be in Big Sur because you're in Big Sur. I mean, you know, you're camping. There's a reason why those campsites are sold out within moments every year if you're trying to camp in Big Sur where you don't even have a roof over your head. But.

Yeah, I mean, to get there, too, there's ways, like when the one is closed, there's ways to go around it, up and around. It takes a longer time, obviously, to get there, to leave there. But, but yeah, it's just, it's so. Once you have been there and you hear about it being threatened, it hits that much harder. You don't want anything to happen to the stretch of California. Yeah, there's a good, you make a great point of if you are interested in all things digital, for example, you want to go touch nature. This is a great place to do it. Do it from the passenger seat. I noticed this last month when my wife and I made that drive down Highway 1. I was so jealous of her because she got to look at every, like you come around the turn and it's just another postcard, another postcard, another postcard, and I'm trying to keep the car on the road. Well, what I did is I just, because we're in no hurry, you weren't in any hurry either when you were driving through, is I was driving when the first time I did it, and I just pulled over like six times. Yeah. I would just pull over to the side and we would get out and so I could look, so I could continue to drive the car, but also. look out at it because you're right. It's hard to keep your eyes on the road. And that is a road you want to keep your eyes on. Yeah. It's a two-lane road for a much part of it. There is also, I was amazed. I've made the drive before. We had gone to Big Sur a couple of years ago, but that was when the road was closed. So we had to go up and around and then go back up through Monterey and come down 101 to get back home. But I was going all the way down 101, all the way down into like Morrow Bay, San Luis Obispo. The number of homes that are... tucked away sort of below the highway between the highway and the actual water is amazing. And they are magical, magical places that I can't imagine how far away you are from everything. Yeah, but just like some of them look like they're just hanging off a cliff. I don't know. It's kind of unnerving, but very cool. The new indictment of Nick Reiner that was announced yesterday does make him eligible potentially for the death penalty. I just want to clear this up right away. He was eligible. Death penalty was already on the table because there were multiple murder special circumstances. So I don't know why the media is saying now it's on the table. It was on the table with the original charges. Well, and I'm curious about how that changes if this grand jury thing changes other than removing the need for a preliminary hearing. It's all it does. All it does is remove the preliminary hearing and maybe speed things up a little bit. And we'll talk about that.
