SCOTUS Restores Access to Abortion Pill by Mail

Back now here on the Ryan Gorman show and let's bring in ABC News legal analyst Royal Oaks for some insight into these court decisions tied to the abortion pill Miffapristone. Royal, thanks so much for taking a few minutes to come on with us. So what's going on with this drug, which, you know, back when we talked about the Supreme Court ruling on abortion, you know, we had discussed the fact that there was going to be an ongoing battle in the states over abortion. and there was going to be a big battle tied to these male order abortion pills. And that seems to be what we're seeing here. That's right. The battle has arrived. So the background is when Dobbs, the Supreme Court ruling that overruled Roe versus Wade, when Dobbs said, people were wondering, okay, we kind of get it. States may ban abortion, but what if you want to get the abortion pill by mail and you're in one of those states? Well, Louisiana went to court and said, Your Honor. Don't let folks in Louisiana get the abortion pill because we have banned abortion. And the trial court and the appeals court agreed with them. But now, Samuel Alito has said, nope, I'm going to stop that. The Supreme Court is going to look at this. But for now, you may still get your abortion pills over the mail. So a lot of people are surprised because Samuel Alito was one of the five justices that ruled against Roe. So this isn't, and we always have to. Add in these points of context for some of these rulings, this isn't a final ruling on this issue. This is just saying that the mail order abortion pill can continue, including in states that have outlawed it for the time being. Exactly right. This is just temporary. So now what's going to happen is the U.S. Supreme Court will either sink its teeth into this tough issue itself, or it may send it back to the lower courts with some instructions. But this is a signal, I think, that the Supreme Court probably is going to lean toward allowing people to get the abortion pill nationwide, even if they happen to reside in those red states that have banned abortion under dogs. What about the timeline for a decision like that? This is going to play out for quite a while, correct?
It probably will. But that's a big unknown question. We don't know how fast the Supreme Court will rule. We know now it's just on hold until May 11. After that, it could move very slowly or it could move like a runaway train, and we could get a final decision one way or the other in the next two weeks, or it could take a year or more.
