94 segmentsThis is an I-Heart podcast. Guaranteed Human. Our little podcast is the podcast that could, the little engine that could. You know, when we started, it was just a simple rebroadcast of our show, and they would take it over and put it on this new podcast platform. I didn't think anything of it. Before long, we started hearing from people all over the country where we don't air on the radio in the town where they are. And I would say, well, how are you hearing us? Did you find us online? And they say, no, I was on a podcast. Or, as happens for more than anything else, somebody sent me an email, say, hey, check out this podcast. He's from Houston, talks a lot about Texas, but talks about national stuff, and I think you'll like him. And that's how our little podcast grew to be one of the top in the country. It's pretty cool. And so we have show sponsors on the radio. We have show sponsors on the podcast. One of them's a good buddy of mine. His name is Ray Breyer's. And he owns the Pipeyard Inc. And what he does on his cell phone is people call and go, hey, I got a 118 mile pipeline going through Louisiana into Mississippi. And he says, all right, let me go check it out. He goes out. He rips that pipe out of the ground all the way. And he goes off and sells that to somebody else who needs the pipe. It's a beautiful process. And people call him all from our show, from our podcast, all over the country. Thepipeyard, inc.com. 409-788 pipe. 409-78 pipe. Talk to Ray, the pipe ma'amma, good buddy. Turns out, at least according to my urologist, that all that talk about taking testosterone is bad for your prostate. That was based on one study that's been debunked. But you know what? Don't trust me. Do your own reading. Cross-reference. Learn more. Go to fixmylowtie.com. That's synergenics. That's who I use for my testosterone replacement. It makes me energetic. It makes me happy. I lost some belly fat out of it, which was really nice. And yes, it does that too. Fix my lowt.com. You paid your insurance premiums hoping that you would never get fire, smoke, damage, water damage, hail damage, hell, we have so many. storms and hurricanes come through here. And the national carrier now doesn't want you, doesn't want to pay you. Chad T. Wilson law firm fights so that you do. He is the lawyer that will fight to get you covered. Go to claimdenied.com or email me and I'll connect you. Claimdenied.com. It's that time. Time, time. Lock and Load. The Michael Vary Show is on the air. For our immigration policy to make sense, it is necessary to make distinctions between those who obey the law and those who violate it. Therefore, we disagree with those who would label any effort to control illegal immigration as somehow inherently anti-immigrant. Unlawful, immigration is not accepted. Mayor, fully implemented, regardless of pre-existing conditionability, pay, and regardless of your immigration status. Samerson is the only universal health care plan for all undocumented residents in America. I'm very proud of that. Our ultimate goal is to help the dreamers but get a path to citizenship for all 11 million or however many undocumented. There are here.
11 million people living in the shadows, I believe, are already American citizens. These people are just waiting, waiting for a chance to be able to contribute fully. And by that standard, 11 million undocumented aliens are already Americans, in my view. An undocumented immigrant is not a criminal, and we have to correct course in this conversation. Immigration is not a right. Guaranteed by the U.S. Constitution to everyone anywhere in the world who thinks they want to come to the United States. Immigration is a privilege. It is a privilege. Before we move on to the Supreme Court hearings regarding men in women's sports, I saw a post put up and had somebody tell me it was put up. by a woman who runs the Houston chapter or the Harris County, which is what Houston is in, chapter of a group called Moms for Liberty. Moms for Liberty describes itself as helping parents make sure their children are safe and well-educated in the schools. It's a mommy-oriented, parent-oriented organization. But I saw this post, and it kind of related to all this Somali fraud stuff. It said, Moms for Liberty's mission is fighting for the survival of America by unifying, educating, and empowering parents to defend the parental rights at all levels of government. What I'm about to tell you is outside of that mission, but it needs to be said. We had one of our cars stolen right before Christmas. It was discovered on January 2nd, 2026. All right. So before I get any further, if you've ever had a car stolen. So imagine this. You never find out your car was stolen at a good time. You're on your way somewhere. You're going to the hospital. You're going to drop your kid off at school. You're going to pick your kid up at school. You're probably running late or on a tight schedule. You're on the way to work. You're on the way to a meeting. You need to close this deal. And there's a sick feeling that comes over you. Oh, no. No, no, no, no. This isn't happening. This isn't happening. And then there's a sense of being violated. Somebody took time out of their lives to steal what you own. Oh, man, it makes me mad. So that's where this person's head is. We had one of our cars stolen right before Christmas. It was recovered on January 2nd. And at the time of recovery, a man was found sleeping in the car. Oh, that's nice. I bet it smells good. We were thrilled to get the car back, but the car is very damaged. It's been a major headache and a costly experience for us. Not to mention the violation we have. From having a car stolen, along with items left in the car, they're now gone forever. So your kid's backpack, whatever it is you keep in the car might be important. Maybe your grandmother gave you the rosary that she prayed her entire life. And they ripped that and threw it out.
Or maybe she gave you her wedding ring that your grandfather proposed to her with 70 years ago, and they pawned that for 10 bucks. The man that was in the car was charged with a misdemeanor, as opposed to a felony. A more serious, felony is a more serious charge. Criminal trespass, knowingly entering and remaining in the vehicle of another. He received a general order bond, which means he went free. As a result of the O'Donnell Consent Decree, that's where the Harris County government, under a Democrat, signed a decree and said, you know what? We haven't been nice to our defendants. We agree. And so we're going to bind our judges so that they have to let bad guys go the minute they're arrested. And they'll never come back for court, but that's okay. Released in order to return to court on January 9th. Spoiler alert. He didn't return to court. Just days later, January 11th, that same man was charged with a felony this time, unlawful operation of a motor vehicle intentionally and knowingly operating a motor-propelled vehicle, namely an automobile. So they didn't charge him the first time with stealing the car. They charged him with being inside the car without authority because they didn't want to make the case that he stole it. All right. Second time they caught him dead to rights driving a stolen car because we know he's a car thief. Then they catch him the second time and an ICE detainer was placed on him, which means he's in the country illegally. She says essentially, He got a slap on the wrist after he was found in our vehicle. He was released. And then he went out and committed the same crime a couple days later because that's what they do. He is not a U.S. citizen. My family pays our taxes. We're productive members of society. We give back to our community. We've served this country. And yet our government is failing us. This is what I am talking about. People are sick and effing tired of our government, allowing bastards into this country to eat at the core of our people. Rape our children, rape our women, murder men, steal our cars, break into our homes, defraud our government, steal our money, and stand out in the street and call our cops bastards and spit in their face. I'm done with it. Everybody's done with it. There should be nothing less than fix this problem overnight or get out. And that includes every single Republican. Be ready to vote against Republican incumbents. It's the only way to fix the problem. Yesterday we spoke to Professor Josh Blackman about the hearings before the Supreme Court now. I know this can be confusing. People will often ask, you're not going to get a ruling from the Supreme Court. It's not an administrative hearing. where you have pleadings and then you get a ruling. These rulings will come out toward the end of the session, and that's several months away. There is a calendar for the Supreme Court, and I don't think, I don't know if media doesn't understand that or they're just trying to hype you up. But when cases are being heard, they make it sound like there's going to be a decision shortly, and that's not how it works. I would tell you,
Do not be afraid to listen to Supreme Court hearings. You can find them online. They're carried live. It's not primetime TV because it's not that compelling to people. But if you pay attention, you don't have to be a lawyer and you can understand it. You have judged a barbecue contest or maybe your kid's second grade art contest. You've been a judge before and I want you to be a judge now. And I want you to be as objective as you can, even though you already have an opinion on the issue. And that is, should boys be allowed to participate in girls' sports when we know it's a scientific fact, boys are stronger, bigger? That's why we always separated them before. It's not only an issue of fairness. It's an issue of safety, as we've seen, where girls in anything contact-related are getting terribly injured. And contact related can include volleyball, where a boy is spiking the ball so hard that we've had, you know, orbitals shattered. We've had serious, we had girls concussed by boys hitting the ball so hard because there's so much stronger than girls. It's why girls don't play pro football. We're different, boys and girls. It's really creepy, like, that they can create a situation where we're having to argue whether the sky is blue, whether water is wet. We're now arguing whether there's a difference between boys and girls. They can shake the very foundation that we stand on. And the reason isn't because they have truth on their side or they make a good argument. It is because there are people in your orbit. who will vote for that side and not hold them accountable for crazy opinions. So here's Samuel Alito. I want you to be the judge in this case. Samuel Alito, one of our guys, conservative, he asked the attorney representing the trans athletes, if a school has a boy's track team, a girl's track team, And a boy who has never taken puberty blockers should be allowed to participate on the girl's team if they identify as a girl. So they have a boy's team. They could be on the boys' team, but they say, I want to play over there because it's easier because then I've never won a track meet, but I can win the state championship. And that has happened again and again and again. Here is that. This school that has a boys, let's say, track team and a girls' track team. The school has that. And a student who... has the genes and the reproductive system of a male and had those at birth and has never taken puberty blockers, never taken
Female hormones, never had any gender altering or affirming. Surgery says, nevertheless, I am a woman. That's who I am. Can the school say no, you cannot participate on the girls' team? Sorry, so you're just a birth sex male who has all the advantages of birth sex male hormones and can the school borrow him from the woman's team? Yes, they can. But that person, is that person not a woman in your understanding? The person says, I sincerely believe I a woman, I am in fact a woman. Is that person not a woman? I would respect their self-identity in addressing the person. But in terms of the statute, I think the question is, does that person have a sex-based biological advantage that's going to make it unfair for that person to be part of the women's team? And that's the rationale for the regulation. And so that's the way we would be testing that hypothetical. Well, the reason I'm asking has to do with discrimination on the basis of transgender status. So what you seem to be saying is, yes, it is permissible for the school to discriminate on the basis of transgender status. is a trans woman, a trans girl, and is barred from the team, from the girl's team, then that person is being subjected to differential treatment based on transgender status, right? Well, then the question would be whether the scrutiny would be satisfied. So from our perspective, that would be a transgender classification. It would get heightened scrutiny, and it may be satisfied here because of the need to curtail unfair athletic advantage. That would be the analysis. We are not pressing in this case the notion, and the case does not require the court to decide whether transgender women who have gone through puberty and have not suppressed their testosterone would be able to play on a men's team. And the record here is a preliminary one where that doesn't present that question for the... court. So she can't define what a woman is and is not, or what a man is for that matter. Her only definition, and this is a sign of true insanity, is you are whatever you claim you are. Okay, I claim I'm black. Why not? I claim I'm 12 feet tall. I claim I'm a midget. How could I not be? I say, I'm a midget. You're now you're six feet tall. I know, but I feel. How tall are midgets from home? Three feet tall? I feel three feet tall. But scientifically, we can measure you. Yeah? scientifically we can measure a lot of things that can determine whether someone's a male or a female. But the follow up to that is this very important moment. I don't have time in this segment, so I'll get to it in the next one. Samuel Alito asks that same attorney, I just laid out a premise of if they have a boys team and a girls team.
And this boy who identifies as a girl wants to be on the girl's team. And she answered the question. But how do we know what a boy is? And how do we know what a girl is? If you can remove the definition of everything, then there is no meaning to anything. And now you have absolute chaos and disorder. And that is exactly what they seek. A lack of any precision. This is the difference between science and madness. There are no facts, you see? There is no reality, so there is no truth. Ray Breyer's is the pipe man. He owns Pipeyard Inc. and they buy and sell pipe all day long. And I am shocked how much business we've been able to send him across the country. Entire pipelines going across three different states where they need to get the pipe pulled out. He's like, I'll pull the pipe out, I'll sell the pipe. People buying pipe, people selling pipe. The people that buy pipe are environmental managers, pipeline project managers. Somebody that's got an abandoned pipeline that's been removed. They want the pipe yard ink, compliance and regulatory folks. They want to get those pipes out of there. Selling pipe, folks that need carbon steel pipe, the pipe yard ink stocks everything you need, any kind of pipe. There is stuff that people call him for, industrial stuff, that he doesn't even have, and he tracks it down. He's working his phone, and his team is working their phones all day long. He's got a yard, they've got pipe. They are working the phones to get stuff for people all day long. 409-788 pipe. 409-78 pipe. I'm on testosterone, and I encourage everybody else to be on testosterone. If you're below 350 on your testosterone level, a very good chance your insurance will pay for you to have it. You know why? There's a lot of studies that say it's very good for you, not just your sex life, but your energy, your strength, all sorts of good things. Do your own research. Don't trust me. But you should do your research, and you should get your blood panels checked. And they'll do all that for you at synergenics. Go to fixmyloti.com. Fix my lowtie.com. You paid your insurance premiums, hoping that you would never get fire, smoke, damage, water damage, hail damage, hell, we have so many storms and hurricanes come through here. And the national carrier now doesn't want you, doesn't want to pay you. Chad T. Wilson law firm fights so that you do. He is the lawyer that will fight to get you covered. Go to claimdenied.com or email me and I'll connect you. Claimdenied.com. One of our guys, one of the good guys. Ask the attorney representing the boys who want to play against girls. He said, hey, school has a boys track team and a girls track team. And this boy who has never taken puberty blockers, so he's making it the most egregious case. This boy doesn't in any way try to be girly. Should he just be able to go, hey, I'm not good enough to win the boys event, but even 10th best boy is better than the girls. Should I do that? Should he be allowed to do that? Right. And Samuel Alito says,
So he's used the term boys and girls, and she's agreed with that, even though she used at one point how he identifies. He asked, here is the question. And Matt Walsh made an entire documentary about it. This is the Matt Walsh money question. What is a woman? What does that mean? Can you define it? Is it not necessary for there to be for equal protection purposes, if that is challenged under the Equal Protection Clause, an understanding of what it means to be a boy or a girl or a man or a woman? Yes, Your Honor. And what is that definition for equal protection purposes? What does it mean to be? A boy or a girl or a man or a woman. Sorry, I just understood your question. I think that the underlying enactment, whatever it was, the policy, the law, we'd have to have an understanding of how the state or the government was understanding that term to figure out whether or not someone was excluded. We do not have a definition for the court. And we don't take issue with the, we're not disputing the definition here. What we're saying is that the way it applies in practice is to exclude birth sex males categorically from women's teams and that there's a subset of those birth sex males where it doesn't make sense. to do so according to the state's own interest. Well, how can a court determine whether there's discrimination on the basis of sex without knowing what sex means for equal protection purposes? I think here we just know, we basically know that the, that they've identified pursuant to their own statute. Lindsay qualifies as a birth sex male, and she's being excluded categorically from the women's teams as the statute. So we're taking the statute's definitions as we find them and we don't dispute them. You understand that? This is important because they can scream and holler, but at some point, When they have to sit still and explain what they have to say in the light of day at noon, when you force them. Because normally what they do is ad hominem attacks. You're just anti-trans. You're a racist. You're mean. You're hateful. I have a brother who became a girl. And she killed herself. And you're the reason. Okay. What is a boy and what is a girl legally? You're unable to answer that question. So what you're saying is you don't want there to be a legal distinction. That's what we're talking about. You don't want there to be any clarity in the world, even though there is biological clarity. Let's move on to another justice, shall we? Uh, Joe Biden, who will we be hearing from next? Those are the words of Ketanji Brown Jackson, our Supreme Court justice. Um, that's the woman he put on the Supreme Court in he doesn't know her name. The D.E.I. Justice, that's what she is. She's the D.E.I. Supreme Court justice. Uttered these words.
As if she thought we lived in an upside down world. Listen this. We are now looking at the definition of a girl and we're saying only people who were girl assigned at birth qualify. Yes. We're being so exclusive to boys by saying they can't be girls. Hey, Johnny Holmes. You say you're a girl? Swagger on in here with all three legs. You're a girl because you say so. It's so absurd. It's a wonder we ever lose an election. It really is. Idaho State cross-country runner Madison Kenyon and the CEO of Alliance Defending Freedom, Kristen Wagner. We're on CNN. addressing this issue, boys participating in girls' sports. The ladies were asked about making sure that trans people feel included. Listen to their answer, though. How do you see the issue of including trans people in school activities in the community in a way that makes them feel included? Because I will say, looking at this, you'll hear, and we had someone on the other side of this issue on the program last hour, there's certainly a feeling of being excluded. So I just wonder from sort of your point of view, how just on a very human level you see that. I think it's important to see that anyone should participate in sports, but sports is based on biology. And that's why it's important that women only compete against women. So anyone can play sports, but where is it most fair? And for women, that's only against women. And can I just add, I mean, this idea of kindness and compassion, we should be extending that to all people, no matter how they identify. And we shouldn't be making differences on the basis of how someone identifies if that's not relevant to the particular inquiry. I think the other big piece to put there, you said, how do they feel? Well, I want to focus on the harm to the girls because even in the case before the Supreme Court, over 420 girls have been displaced 1,100 times and lost 57 medals to the boy at the heart of the case. So let's talk about how those 400 girls are feeling in this moment. That's the group that doesn't get talked about. Adam Smith famously said that Mercy to the guilty is cruelty to the innocent. Democrats love to, in a Sarah Sarandon sort of way, Susan Serenden sort of way. They love to make the murderer, the rapist, the pedophile, into the victim. They didn't mean to do it. They had a tough childhood. They were going through some things. Okay.
You've now forced everybody to focus on the person who bludgeoned someone else to death. Now about the person, how about the person who is bludgeoned to death? Let's talk about what a good person they are and how they didn't ask to be bludgeoned to death. Right? How about their family? Let's talk about them. The left always chooses the wrong person to focus on. They focus on the goodness of the murderer because, well, he's black. He didn't have a chance. He was poor. He didn't have a chance. He's got psychiatric problems. He didn't have a chance. But what about his victim? Right? So you're so worried about a boy who, by the way, could compete against other boys. But no, you want to give him an unfair advantage against the girls. Well, what about the girls? And all of these Democrats used to claim to speak for women, but they don't, do they? This has caused a lot of women to wake up and realize if we're the victim of a crime or you get a boy in our... The Democrats aren't on our side. Conjunction, junction, what's your function? The Michael Bari Weiss Show. Conjunction, junction, how's that function?
comedy. It's a wonder I can think at all. And my lack of education hasn't hurt me none. I can read the writing on the wall. Comedy is so powerful. You know, a lot of people on our side don't know that. Don't understand that. I find this to be the case. We've not done well in the comedy space until relatively recently. And I think as a result, we've been able to appeal to younger people. Younger people like whimsy and comedy. They like irony. They like to laugh. They like snark. Our people tend to be very serious all the time. We're not going to laugh. We're not going to have fun when we talk about politics. Things are so bad in this country? How can you laugh? You can't laugh. Those things are bad. Well, if you can't laugh, you can't attract other people to our philosophy because you sound angry and they don't want to be angry. You sound like get off my lawn man. And when I tell people on our side that they go, well, that's fine. I'm angry. Okay. So now this is really about... your personal emotional projection and not about winning elections. And that's where I part with you. I learned a long time ago that there are plenty of people who are fellow travelers with me ideologically, but they don't care about winning elections. They don't want to win elections. That's not even in the top 10 of, they want to tell people how mad they are and lecture people on how mad they are about everything. But when it comes to explaining that out of that anger, we can fix the problem? They don't want that. No, no, no. It's more indulgent to just be angry. South Park has an ability to not only lampoon the left, but to do it so subversively that the left laugh at themselves in the process in many cases. I don't watch the show, but people send me clips of it all the time. And they nail it so many times. So here's a great example. At the school, the bathroom, Cartman, who's one of the stars, wants to use the girl's bathroom so he can go in the toilet because they have more stalls than the boys do. So he claims to be transgender so he can use the girl's bathroom. But in him being a little twit to the administrator, you can't help but laugh. Hey, Eric, I'm not suspended no more. Good for you. I think someone's in there. No, damn it, no. Who's taking the shit? Occupied. I call dibs on stall one for all recess, Craig. You can't call dibs on a toilet. Son of a bitch. Oh no, no, no, no. I cannot go another lunch break without my toilet time. Then don't eat 14 egg of waffles for lunch, fat ass. All right, that does it! I'm sick of this! And I'm not taking it any longer! You all push me to this! What the hell do you think you're doing? I'm going to the potty. This is the girls' bathroom! All right, I need to tell you something, Wendy. I'm transgender.
What? Did you notice the bow? I'm not comfortable with the sex I was assigned at birth, so I'm exercising my right to identify with the gender of my choice. Now get out of my way after take a... Ugh... Get out of here! Don't give me more issues than I already have, Windy! Oh, wow, this is nice in here. The girl's bathroom's bathroom's a lot cleaner than the boys. What the hell is that? Cartman is using our bathroom. Dude, this is awesome. I should have used the girls' bathroom a long time ago. Hey, I'm gonna tell on you. It's okay, Red. I can take it here. I'm a dumb shit, too. I want to know just what makes you think it's okay to go inside the girl's bathroom. Because I'm transgender. I looked it up. That means I can use the girl. You are not transgender, Eric. You don't even know what that means. Yeah, huh. It means I live a life of torture and confusion because society sees me as a boy, but I'm really a girl. All right. Well, if you identify yourself as a girl, you must find yourself attracted to. Is that right? That's actually not true. I can be transgender without it having anything to do with the gender I'm attracted to. Check the state bylaws. All right, listen, Eric. Erica. Listen, Eric. You must know why we can't have you in the girl's bathroom. All I know is I'm Trans Ginger, and you can't make me go to the bathroom with the cis gingers. With the what? Cisgender. It's the politically correct name for people who aren't transgender. If you identify with the sex you were born with, then you're cis. But then cisgender is just normal. Saying normal is extremely offensive to people who aren't in that group. Trust me, you don't want this hot potato. Just let them use the girls' room. But this isn't a hurting, confused child we're talking about. This is Eric Cartman. Nobody else is going to know that. You better just give him what he wants. So Eric Cartman just has us in some kind of bathroom checkmate? Actually, it's more like a royal flesh. That's pretty good. For months, the Democrats in the media told us the Epstein investigation was one of the most important issues in this country. What happened? Kind of like kneeling at the football game. Did we solve the slavery problem? I notice they're not kneeling anymore. They get bored. So is the Epstein investigation not important any longer? Bill and Hillary refused to appear after being subpoenaed for deposition as part of a congressional panel investigating Epstein. But didn't they tell us that when Trump refused to appear before a Democrat Congress, after he was subpoenaed, that that meant he was 100% guilty? ABC News with the story. Bill and Hillary Clinton refusing to testify before the Republican-led House Committee investigating sex offender Jeffrey Epstein, calling the committee subpoena legally invalid. In a blistering letter, the former president and secretary of state declaring, every person has to decide when they have seen or had enough and are ready to fight for this country, its principles, and its people, no matter the consequences.
For us, now is that time. The Republican Committee Chair James Comer, now threatening to hold the former president in contempt. We will move next week in the House Oversight Committee markup to hold former President Clinton in contempt of Congress. House Speaker Mike Johnson sounding fully on board. I think clearly he's defied a subpoena of Congress. I'm not sure what the other remedy would be. It's a contempt. It shows contempt for Congress. In their extraordinary four-page letter, the Clinton's warning Republicans. You were on the cusp of bringing Congress to a halt to pursue a rarely used process, literally designed to result in our imprisonment. And let's check in with James Comey. We will move next week in the House Oversight Committee, Markup, to hold former President Clinton in contempt of Congress. President Trump has answered thousands of questions about Epstein. I bet today, at some point, some of you all, will ask President Trump questions about Epstein. He answers those questions. To my knowledge, former President Clinton has never... answers questions about Epstein. And we just had questions because, again, I think anyone would admit they spent a lot of time together while Bill Clinton was president and post-presidency. Did I say James Comey? Ramon said I said James Comer. It was, what's his name, Comer? Is it Comer? He's the Republican. Not James Comey. Uh, whole Bill Clinton in contempt of Congress. Just that simple. But you know, a lot of Republicans think, as long as we get Bill and Hillary, nobody cares about Bill and Hillary anymore. Stop. You're still obsessed with them. Nobody cares about them. You've got to destroy the Democrats of today. They're yesterday. Yeah, but I still got to hang up. They're hiding under my bed. Give up on the Clintons. You're not winning that battle. You lost it. They got to be president and hang around a long time. Thanks left for building. Thank you. And good night. I hope you enjoy our podcast as much as we enjoy making it. You can always email me through the website, Michaelberry Show.com. I do love to hear from you, and I do respond to you. Tell me where you're emailing from. It's fun. Our podcast listeners are from all over. And wherever you are all over, there's a decent chance that you have or know someone who has a steel pipe that can be sold to my friend Ray Breyer's. at the pipeyard inc.com. They dispatched trucks across the country to haul one load or 300 loads of pipe. I had one listener. In Georgia, his company had an abandoned pipe, an abandoned line running all the way from Louisiana.
through the Southeast Conference of Football, Basketball, and Ray Breyer's, the Pipyard Inc. was able to pull all that pipe out, pay them for that pipe, and then sell it to another user.
