So the court issued a split ruling on January 17th when it comes to the petition. Signatures for the smart and safe Florida is attempting to get to put marijuana and recreational marijuana on the ballot. The court issued a split ruling. The judge blocked and invalidated 42,000. for being an inactive voter signatures, but upheld tossing 29,000 from out-of-state gatherers, both sides appealed. So 29,000 saved, 42,000 thrown out, somewhere around 200,000 short, and the deadline is approaching quickly. The February 1st is the deadline, and they're 205,000 short. And they claim to have over a million collected and many still in the verification pipeline. As it happens right now, we will see if it actually makes the ballot. Now, it did make the ballot in 2024 and it fell short 4% of the needed 60% to pass. But why we sit here and debate it, and I told you guys that this is going to become a partisan issue and where the Democrats are going to push hard for it because they feel like it will be a voter motivating process. That's what it is. They feel like if they do this, the... Marijuana user who doesn't vote will be excited and go out and vote and vote Democrat. And as we're sitting here debating this inside in Tallahassee, Senator Carlos.

Guillermo Smith, a Democrat out of Orlando, filed Senate Bill 1398, which allows adults 21 years of age and older to legally possess up to four ounces of smokeable marijuana or cannabis products containing up to 2,000 milligrams of TAC. He's tried to full-blown legalize it through the legislature. Now, there's other things that they're discussing in Tallahassee, but here we are, a Democrat making the push. We give you your freedoms. Republicans are trying to take them away. Now, I debate, and this is what I'll tell you. For those that are against marijuana, President Trump is declassifying it and making so that it can be taxed, banked, and researched better for its medical purposes. But when it comes to marijuana itself, let's talk about another substance that is legal and that is alcohol. Now, when you take alcohol and marijuana and compare the two, They're both used for social lubrication. They're favored by usually the alcoholic is a drinker and not a marijuana user. And a marijuana user is a marijuana user and not a heavy drinker. Rarely do you see a alcoholic who is also a heavy marijuana user and not to say that it doesn't happen. But let me tell you this because this does happen. 140,000 plus U.S. deaths yearly from DUI violence related to alcohol because someone drinks too much alcohol or they get liver disease from drinking too much alcohol. Now, when you compare that to marijuana, zero direct overdose deaths ever recorded. You don't get violent. when you smoke marijuana, and it has a lower DUI fatality risk per user. That is what they say. Now, when it comes to health costs, let's talk health. Let's not even talk about the other side of it. Let's talk health. Alcohol, liver disease, cancer. Marijuana medical benefits have been recognized by President Trump and the federal government. So there are medical benefits. And we have medical marijuana here because there are medical benefits. There are zero medical benefits for alcohol. And by the way, three quarters of America says regular alcohol use is riskier than regular marijuana use.

So as this argument continues to unfold, I ask everyone to kind of for a second step back from this. And don't look at this as some of you will message me and call it a gateway drug. It's a gateway drug. It's a great way drug. It's the end of the world, man. We're all on gateway drugs. This is a narrative. pushed by those against it. Now, Ron DeSantis is against it completely and has now ordered the supervisor of elections to do a whole process to get the signatures verified. So basically, he went out there and said, The division of elections issued a January 8 directive requiring county supervisors to notify voters the same day their petition signatures are verified of move critics, including supervisors, slam is unnecessary overreach and confuses the voters. The article itself confused me. But you have more than one supervisor of election that has said, there's... No law behind this. This is just a directive and it is going to cause issues instead of just letting the process play out instead of putting a bunch of pack money into the campaign against it. Let the voters say what they want to say without either side pushing their message, and then we'll see what actually happens. I've got Jason on the phone from Punta Gorda. Go ahead. Jason, you're on 925 Fox News. What do you want to say about marijuana? Well. This guy's Bill, this Guillermo Smith. Right. You just, I mean, this is the first I've heard of it. Right, me too. So do people actually understand how much four ounces of marijuana is? I mean, I had a troubled test, definitely had my time of smoking it and slinging it. Four ounces, you basically can get an ounce of marijuana in one sandwich bag, Ziploc public sandwich bag. That's four of them. That's what you could call a quarter pound. That's borderline distribution. What do you need to be walking around in possession of four sandwich bags of wheat? That makes no sense. I mean, if you want to go and take your sandwich bag and go and let's say you, you know, well, hold on, Jason, real quick. Medical marijuana users get to have possessed between two and a half and four ounces of marijuana too, depending on where their recommendation is. What do you, I mean, what do you need to be? That's like walking around with a, with, with.

three 750-millimeter bottles of alcohol going, I need this to medicate myself. In defense of the medical marijuana users, I guess that is the possession limit, but you also only have that purchase amount like every 70 days or something like that. I don't know the actual timing behind it, but it's like a certain amount that you can purchase. So if you went in on your brand new day and you purchased your entire amount and just held on to it, like you're going out in the Sam's Club and buying Coca-Cola, then you would have. that much. But you're right. That is a lot of marijuana. And, but what this Democrat is doing, Jason, is he's pushing the narrative and making it a partisan narrative. Democrats are going to say, hey, if you want to smoke it, smoke it, man. We think it's okay. They want them numb. They want them numb. They want them not paying attention to what's really going on in the world. You know, I've been sober to stop drinking almost six months now. And it's like, Sobriety opens your eyes to freaking everything. A lot. And you really start to see how people are, how they treat you. It's crazy. So I don't know. I mean, I'm still on the fence about the- Did you quit cold turkey on the booze? Did you quit cold turkey on the booze? Yeah. Right. I did two ones for three and a half. July 27th. I did three and a half years of not drinking just to prove that I didn't have to drink. Now, here's what I'll tell you real quick. Were you a full-blown drunk when you quit? By the way, I'm just asking. You don't have to admit an argument. I mean, I would go home and have a couple of, uh, that's where I was. I felt like I was just overdoing it. And then someone says, you're a furblown alcoholic. I'm like, I'll quit right now. They're like, you can't. I was like, watch me. And I did for three and a half solid years. And now here's the funny thing. I won't even drink two beers ever. Like one beer, one and a half, maybe two at the most, that's it. I just don't crave it. I don't want it. I don't like it. And by the way, I've had a six pack of mini beers in my fridge outside by my deck. I don't know. For three months and there's still four in there. That should tell you. True. I see a guy walking out of publics with a suitcase of beer, and I'm like, good luck tomorrow. Right. It's going to kill him. All right, I appreciate you. Thanks for calling in, man. All right. Well, I think. that if they're going to say that marijuana is going to be a medical need, then it should be a prescription. It should be controlled. So if they're going to carry marijuana, they have to carry it in like a prescription bottle or something. They do. But some people don't. Some people carry it in a bag. Well, that's illegal. That's illegal marijuana. If it's medical marijuana, it's distributed inside a container that has a prescription label on it and everything. Yeah, but some people, they take it out of the bottles and put it in bags. But according to the laws of medical marijuana, that's illegal.

Uh-huh. Just because you have a card, if you have a medical marijuana card, your marijuana still has to be in the packaging. You can't take it out of the packaging. Once you take it out of the packaging and becomes an illegal substance. That's right. So I think people should have it control, everything, control alcohol, especially when the higher, there's more problems with people with alcohol than with marijuana. So do you support the legalization of marijuana? I think if it's controlled, yes. But if it's not, you know, some people abuse it. A senior federal judge just denied most of the city in Naples motion to dismiss ruling drag performances of protected First Amendment speech. Now, it's a split ruling, so let me give it to you. Just happened, January 15th. The judge denies the city's dismissal attempt on the main claims, but also... dismisses all claims against city officials in personal capacity, no personal liability for any of the city officials. It's a city versus the ACLU. That's what's going on. Now, where did this all start? That's what I wanted to find out. So let's go back so that we can understand that parks are for families, all families. In 2023, Florida passed the Protection of Children Act and bans adult live performances with lewd content accessible to minors. City repeatedly denies Naples Pride permits 2023 through 2024 and citing the state law. In April of 2025, Naples Pride with the ACLU sues the city, claims censorship and First Amendment violation. In May of 2025, the judge grants a preliminary injunction calls event family friendly and blocks the minor ban. In June of 2025, the 11th Circuit stays the injunction and forces a 2025 Pride Fest drag show indoors and makes it 18 and plus. Now, the state law that we mentioned earlier remains partially blocked statewide, but the AG is fighting to revive it, and the split ruling keeps the pressure on the city with no quick knockout. But this is what I would say, and if you know somebody with Naples' pride, or for that matter, any one of the pride organizations throughout Southwest Florida, there's Cape Coral and Fort Myers, everyone has one. This is what I'll say to you.

Why are you pushing for it to be all ages, and why are you pushing for it to be in public? Why are you trying to push that? By you pushing that, it makes it look like you're trying to push the narrative on those who are not LGBTQ, M-T-L-T-Q-P-C-F2-C-C-O-GB, right? I'll give you an example. I've never met a straight family. It goes, hey, what are we doing this weekend? Hey, you want to go to the pride event? Yeah, let's go down there. That'll be great. I'm not saying the straight people don't go to pride events. I'm saying families don't get together that are all straight and go to a pride event. Parks are for families, for the kids, for everyone, not just one group. And that's the issue with this in the park. Now, vegetarians. Don't demand that there's carnivore barbecues included in their tofu tents. Gun owners don't force anti-Second Amendment rallies to host shooting demos. Christians don't demand atheist conventions and include prayer circles. And sports fans don't invade rival tailgates and make them do their chant. See what I'm saying? It's just not what they should push. Keep niche. Keep that little small fraction of adult entertainment private. Public parks belong to all families, especially the kids, and we cannot allow that to happen. This is why it is not a... freedom of speech, a first of, I mean, come on. Are you kidding me? Live your life however you want, but don't force it on me. And when you're trying to force it into a public park, you're trying to force it on me, which requires me and the other conservatives to stand up and go, uh, that ain't going to happen. Not today. Not today. Rachel, good morning from Naples. Go ahead. You know the organizer of, uh, the Naples pride. Go ahead. Yes, it is definitely her agenda to keep it in downtown Naples. She was given the opportunity to take it out to Paradise Coast, where she had a bigger area. It's definitely her agenda, though. I know her through friends, and she is definitely, that's the type of person she is. She wants it in your face. Right. She wants to push the liberal agenda, get out there, say, this is right. She wants to do it. Now, do you know her personally? Do you have conversations with her? I've had conversations with her, not regarding Naples' pride, but other than that, she is all about, I am gay, look at me, you know, you have to accept me, and I can throw my agenda around and, you know, put it out there. Now, I had volunteered at the gate twice. two times after that I was like, I'm done because I was saying things that I just did not accept. Wow. I appreciate your phone call. The markets are closed today for MLK Day, but Tuesday kicks off a massive week, delayed data, big earnings, a lot of things to discuss about, and we bring Alfie on to discuss those today. Alfie, good morning. How are you doing today and how was your weekend, buddy? It was a good weekend. Happy Martin Luther King Day. Yeah, it was a cold weekend, like a cold Monday. I can't believe. Can't get the boat out anymore. The water's so low around here. It's crazy. Who would want to take the boat out today to be like 25 degrees? Right. Not a day like today. All right. Let's talk a little bit about the big week we got ahead of us. The market closed today. Are we finally beating inflation? Are we finding out that we're beating inflation or are we not? Where are we at on inflation there, Alpy? We're going to talk about that, but I'm looking at the futures because they're running the futures right now, and they are down quite a bit. They're down like over 1.5% for the NASDAQ, 1% for the Dow, and it's because of the tariffs, the new tariffs that might be imposed on the European country. So that's something that we probably have to keep an eye on. So tomorrow's probably going to be a pretty volatile week, you know, a day for tomorrow when that market opens if it's anything like this. So that's unfortunate about that. So getting into terrorists a little bit about tariffs, we've spoke about tariffs before, all right? And now it seems like his announcing new tariffs that could hurt the market, could hurt us financially. Are tariffs a good thing or a bad thing from a financial standpoint, Alfie? I think they're good negotiating. For negotiating, they're good. They already have a 10% tariff. And some of the countries have a 10% and 15% tariff. But now they're talking about another 10% tariff that would put it at 25%. And so that's not good because that's going to create added costs for the consumers here in the U.S. So we're the ones that are going to have to pay that. So that could hurt inflation.

That's why I'm hoping it's just talk. Okay. Rhetoric. I'm hoping it's just talk, but we'll see. It's supposed to, I think it goes, goes in effect February 1st. You know, it all goes back to Greenland. You know, this is, obviously, this is a very important place that we need for. for you know strategic and for our military base and and uh national defense right so mm-hmm so he's not going to let up on it and and these other countries and we've been really we've had military base there for for a long time so I don't think it's anything out of the ordinary. Let's talk a little bit about what we are going to see this week. Are we going to see earnings big from any particular type of company? And let's talk a little bit because you sent me notes. Well, first, let's answer the first question, and then I'll get into the second one. Let's talk about earnings and what we should look for. Then I'll get into my second. Go ahead. Yeah, so we do have some, you know, the... You got personal consumption expenditures. Those are, that's the PCE and GDP data because, you know, remember, we were closed down. So these are going to be, these are sort of like older ones that are coming back from last year. So we're going to see what the third quarter GDP is. And we're thinking it's going to be pretty good. If the numbers, if they are good, then that means inflation is getting more optimistic. about inflation and then you you know again rate cuts you're only looking at a lot of the experts are saying no rate cuts for this this year you know i'm thinking we're going to have probably one maybe even two but a lot of people are are saying we're not going to have any rate cuts this year so that's not but we do have a new fed coming in in may and that's going to that could change a whole scenario right there mortgage rates just plunged down to 6% and lowest over three years but I mean it seems like we're going in the right direction is this just a temporary bandit no I think I think I think it will you're going to see rates go down a little bit um But, you know, when you do the 10-year, that's what, remember, when the feds cut, that's for what banks charge each other. It's not really, it's not tied to mortgage rates, but it all comes together down the road, but it's not really tied to mortgage rates. But if you start to see, you know, a couple of rate cuts, you'll see a change in mortgage rates. But it could, you know, that 30-year. that 30-year note is what they're looking at for those mortgage rates. And they are, if they can come down a little bit, which they are coming down, we've got to get the housing market going. You have this midterm election that I'm concerned with. And Trump is very aware of it. That's why he's going to go out and make all these rallies this year. And he's doing a lot. You're talking about affordability, affordability. He's starting to talk the talk about it. And you do see prices come down.

But there are prices that are sticky, and then there are prices that are coming down. So it's going to be a fine line. But I think if anybody can do it between now and the midterm election, it's going to be President Trump to make people aware the economy is doing good, people getting their refunds. Remember, the refunds are going to be coming in and that one big, beautiful tax bill. was signed last year in July, but it goes in effect this year. So people should start getting excess monies. So we'll see how it works, how it plays out. But I think it's going to be, now you heard Carville. Did you hear what he was saying about there's going to be, he thinks that there's going to be 25, 45 seats that will be picked up by the Democrats in the midterm election. Yeah, I did hear that. I did hear that. Hopeful thinking, wishful thinking. I got it. I'm a person that thinks positive, say positive things. That ain't happening. Let's talk a little bit about the Russell 2000. And the reason I want to talk about it is because up until this morning, I had to go and research exactly what the Russell 2000 is. Now, I know what the NASDAQ is, but tell me a little bit about the Russell 2000 and what it is for everybody out there that never heard of it like me. So the Russell 2000, these are small caps. These are smaller companies valued at about $250 million to $2 billion. So they have value. But, you know, they're not looked at as much. So, you know, savvy people can really find some deals in these small companies. And these small companies become large companies down the road. And that's where in the return, you know, they're more volatile. Those small caps are more volatile. But it's good to have some of them in your portfolio because these, this right now, now they've been lagging for the last three or four years. They've been lagging the S&P. But they're up like 8% this year so far. You know, they're crushing the, you know, they're crushing NASDAQ and S&P. But when you have and they're not as volatile in the sense when the market really starts going down, they are they don't really go up and down like the SMP does or the NASDAQ because they're smaller. and, you know, different companies and stuff. So, you know, it is good to have some of them to have a, you know, you don't want everything going up and down. You have to have, you don't want everything correlated where they both go up, they both go down. So small caps will help you with diversification and to help you with getting excess returns because they are volatile, but when they go up, man, they go up. Well, the same way when they go down, they go down too. When I saw it, I immediately started researching different companies. And there are, there's some great items that are great companies to look at inside that Russell 2000. Absolutely. Let's get to it. Tip of the week. Let's get to the tip of the week. What's your tip of the week this week? So the tip of the week is, it's called the 60 to 63. It's a super catch-up.

Now, and that catch-up, catch-up, and what that is, it's for your 401 cases, people that are aged between 60 and 63. And usually a catch-up is where you're allowed to put excess monies in your 401K. And usually it's $8,000. But for this year, because of the tax bill that was passed, it goes from $8,000 to $11,250. So, you know, about, you know, a couple thousand dollars, I'm with $3,200 more than usually allowed to catch up. So that will save you a lot in taxes. If you have a 401k and you're in that tax or in that age bracket, look into putting that excess monies in there to get that tax break for this year. You know, I've been sitting here debating property tax, but it wasn't until Ron DeSantis said something that really made me understand what property taxes are and why it's important to get it on the ballot. Now, not what they are, I know what they are, but why it's important to get them on the ballot. Listen. Ron DeSantis push. He wants bold cuts. He wants to have a special spring session and wants one big 2026 ballot measure because why, quote unquote, it will juice turnout. Yes. That's exactly what we need. We need major initiatives on the ballot so that it juices the turnout. People will flow to the polls and make sure that they pass the relief of property tax. It will draw way more conservatives to the polls. That's exactly what we need to do. We need a bigger midterm turnout. Just like you just heard Alfie Townshend, the midterms are making them nervous. It's making a lot of people nervous as we turn the corner. But if we do get an initiative on the ballot, it would be great. And there are some that are saying lots of promises, but still little clarity. And that's true. We're in the middle of it right now. The Senate president, Ben Alberton, is more cautious and prefers a targeted relief over a full repeal. What that means is the Senate wants to see something that says, anybody over 60 or anybody that owns more than, like they want some kind of, you know, very much dialed in where the House and more specifically when it comes to what Ron DeSantis wants.

Cut it, get rid of it. We will find where we can get the money elsewhere. And DeSanches just said the ideas that you're coming up within the house aren't good enough. The voters want relief. But we also want our insurance is fixed. And we aren't willing to trade the property insurance for a massive sales tax. I know, we've talked about it. You have to spend $100,000 in goods in one year to equal your sales tax. So if you add that sales tax, right, you get $100,000, you have to spend $100,000 in taxable goods to equal what you spend on your property taxes. Now, when I said this last time, one person was like, well, a new truck is $100,000. That's true. Some new trucks are $100,000. But if you spend $100,000 on a vehicle, then you and I shouldn't even be discussing your property taxes. You should pay my property taxes.

They're surging now with the home values going up, insurance crisis post to Ian, and there's so much going on that we have to figure this out. And there is no state incomes tax. So you don't have a way to pull from that in order to fund your fire, to fund your police, and to fund these different major agencies within our state. That's what property taxes go to. But raise your hand unless you're diving one hand if you'd like to see some property tax elimination. I'm all for it. And you're right. I would never be able to spend $100,000. I don't have $100,000 in goods to spend. Like I don't have that. Like they would take every dollar I make and just spend it on taxable goods. And I'm pretty sure I'm not, I'd have to get an accountant, but I feel like there is a tax write-off for a new car purchase. So that would cover that you would get a deduction for your new $100,000 truck. So that would help when it comes to a sales tax increase. All right.
