But before we do, got to talk about the president's war on the military industrial complex. The phrase military industrial complex comes from a Dwight Eisenhower speech. And January 17th, 1961, as he was leaving office, he said, quote, a vital element in keeping the peace is our military establishment. Our arms must be mighty. Ready for instant action so that no potential aggressor may be tempted to risk his own destruction. The conjunction of an immense military establishment in a large arms industry is new in the American experience. The total influence, economic, political, even spiritual, is felt in every city, every state house, every office of the federal government. We recognize the imperative need for this development. Yet we must not fail to comprehend its grave implications. Our toil, resources, and livelihood are all involved. So is the very structure of our society. In the councils of government, we must guard against the acquisition of unwarranted influence, whether salt or unsalt, by the military industrial complex. The potential for the disastrous rise of misplaced power exists and will persist. We must never let the weight of this combination endanger our liberties or democratic processes. We should take nothing for granted. Only an alert and knowledgeable citizenry can compel the proper machine of the huge industrial and military machine of defense with our peaceful methods and goals so that security and liberty may prosper together.

Eisenhower really wasn't the first to use the phrase or the first to warn about the dangers of the military industrial complex, but it really hit home with people. And part of the issue is that over time, the phrase military industrial complex has taken on conspiratorial overtones and people kind of use it. as a way to cast conspiracy and blame that, oh, you know, it's the military in control. It's the businesses in control. And there are a lot of people who get out of bounds. Eisenhower's point is this. I want to read for you Article 1, Section 8 of the Constitution, one particular clause, two particular clauses actually. Let me start with the beginning. The Congress shall have the power to lay and collect taxes, duties, imposed, and excises to pay the debts and provide for the common defense and general welfare of the United States. But all duties, impost, and excises shall be uniformed throughout the United States. Congress shall have the power to raise and support armies. Now listen to this key phrase here. Congress shall have the power to raise and support armies, but no appropriation of money to that use shall be longer for a longer term than two years, and to provide and maintain a navy. The founders of our republic understood that you always need a navy to protect the coast. to pursue our interests abroad. But it was uncommon in this country to have a standing army. In fact... If you go down below that, you get to make rules for the government and regulation of the land-enabled forces and to provide for calling forth the militia to execute the laws of the union, suppress insurrection, and rebel invasion, to provide for organizing, army and disciplining the militia, and for governing such part of them as may be employed in the service of the United States, reserving to the states, respectively, the appointment of the officers and the authority in training the militia according to the principles prescribed by discipline prescribed by Congress. In other words, it was common for each state to have a militia to have a National Guard. It was not something for this nation to have a standing army. It was not common. The army after war would be disbanded. That's why in the Constitution, we talk about the National Defense Authorization Act every two years. We talk about the Defense Authorization Act. They just reauthorized it. That's the Constitution. Standing apart from the budget of the United States, you can't do a continuing resolution for the military. You have to do a National Defense Authorization Act. Every Congress has to do it because the Constitution says so. Why? Because if you do not do it, the army must be disbanded. Not the Navy, but the Army.

And the Air Force as well. Essentially everything but the Navy has to be disbanded after two years unless Congress reapproves it. Why? Because the founders of the country hated the idea of a standing army on American territory because that's what the British did to us. And the British use the army to oppress the people. So we have posse comitatis. You can't use the military for police affairs in this country. And we also have the National Defense Authorization Act bound by Article I section into the Constitution. You have to reapprove the army every two years. There has always been a distrust for a big military in this country. And along comes Eisenhower after World War II, where we realize our position on planet Earth has changed. Before World War II, we were a growing prosperous nation. After World War II, we were the leader of the free world. And it required our ability to maintain, develop, and deploy weapons, not just any weapons, but weapons that included weapons of mass destruction.

But we had never done that before. And one of the things Congress did because it was Congress is they spread it out across the nation. Why on God's good earth is NASA and all of our rocket center headquartered in Huntsville, Alabama? Because the congressmen and senators from Alabama were very powerful in the 1950s and 60s. Why do we have major military installations and operations and development centers in certain parts of the country? Because of the power of members of Congress. You want to get things done in Congress. You want to get the military to be able to do things. What you do is you spread out the jobs and the wealth around the country. You get congressional buy-in from the... members of Congress by spreading the wealth around. It's what you do. It's what you've always done. And it was Eisenhower as he was leaving office in 1961. By the way, my father's listening right now. I know my dad is listening right now. And I need to say father, I apologize for talking about Eisenhower. My dad does not like Dwight Eisenhower. He is a Harry Truman guy. He does not think Eisenhower was a great president. Every time I talk about Eisenhower, I think about I remember in high school at some point I said something. He probably doesn't even remember, but I said something about Eisenhower when I was in high school, and it set my dad off. One, because it was right around the time Paul Harvey was starting, I'm pretty sure, and two, not an Eisenhower fan. Actually, Eisenhower built the interstate system, but otherwise he wasn't a fantastic president. People just loved him. He played golf more than president, which I guess is endearing because he actually didn't do a whole lot as president since he was on the golf course all the time, down in Augusta, trying to get him to kill that pine tree that finally lightning took out. Nonetheless, I digress. So Eisenhower was warning people, as we're now becoming a permanent militarized society with a massive military industrial complex, we can't allow it to be such a part of the economy that it dominates. That was his point. What actually happened, however, is that it allowed the conspiracy theorists to blame. Like nowadays, you forget, nowadays everything is blamed on the pharmaceutical companies. It's big pharma. In the 60s and 70s, it was the military industrial complex. You know, they killed Robert F. Kennedy Jr. because Robert F. Kennedy Jr. was going to do cutbacks. Right.

This is from the Wall Street Journal. President Trump lashed out at U.S. weapons manufacturers Wednesday announcing new restrictions on executive pay and stock buybacks, while also threatening to cancel contracts with one of the country's largest defense contractors. The executive order posted Wednesday evening, said companies are not permitted in any way, shape, or form to pay dividends or buyback stock until such time as they are able to produce a superior product on time and on budget. Early Wednesday, Trump said in a true social post that he would limit executive pay to $5 million, but the dollar figure wasn't included in the executive order. It wasn't clear how the administration intends to carry out the order beyond using the enforcement tools available to Pentagon officials. Trump also singled out contractor RTX in a separate social media posts, saying the company has been the least responsive to the Pentagon's needs and the slowest in increasing their volume and the most aggressive spitting on their shareholders. rather than the needs and demands of the U.S. military. Either the company steps up and starts investing in more upfront investment like plants and equipment, or they will no longer do business with the Pentagon. The moves Marco Rubio significant escalation in Trump's years-long frustration with defense companies over delayed and over-budget projects, causing anxiety across the industry and raising questions about the long-term viability of multi-billion dollar weapons programs. In his true social post, Trump said he wanted companies to build new and modern factories and said the $5 million pay limit was a mere fraction of what executives are making now. Saying he was addressing defense contractors in the defense industry, Trump wrote that defense contractors are currently issuing massive dividends to their shareholders and massive stock buybacks at the expense and detriment of investing in plants and equipment, the situation will no longer be allowed or tolerated. The Post didn't specify whether the order would curb CEO salaries, which are usually less than $5 million a year. or full compensation packages with stock options and bonuses. Defense stocks fell. RTX shares dropped more than 2% with shares of Northrop government, Lockheed Martin, and General Dynamics, all down 4% or more. But the companies rallied after hours following another true social post calling for a $1.5 trillion defense budget, more than $500 billion more than the Pentagon is expected to receive for the 2025 budget. The Pentagon has been pushing weapons makers to boost munition production by investing more of their own capital and plant expansions. Lockheed, Martin, RTX, and Rethion, the unit of Rethion are the biggest suppliers in sales. Let me explain to you what has been happening, and there's merit to what the president says. If you're a shareholder of a publicly traded company, some of these companies give you dividends. They take a portion of their profits and they give it to the shareholders. The problem is that a lot of these weapons manufacturers, they want the government to come build up their factories for them instead of using their own profits. Now, there are real legal issues about whether the president can do this stuff or not, but the fact that he's cracking the whip, I'm okay with it.

The fact that the president is cracking down on these defense manufacturers, they exist on government subsidy. Boeing is another good example of this. Boeing can barely get a jet out the door and more even in commercial aviation. You know, I'm down in Atlanta. Atlanta is the world headquarters for Delta. Delta has invested heavily in Airbus. They're buying some new Boeing 737 max tins or whatever. But by and large, the Boeing 757 and the 767, I think are great planes. The triple 7 is my favorite plane, also one of the safest ever built. But Boeing's got all sorts of problems, and Boeing exists on government subsidy. Boeing needs government subsidy, the Export-Import Bank, to survive. These other companies, to a degree do as well. I don't have a lot of sympathy for the defense manufacturers. Is the weapons process convoluted? Yes. But why, in a lot of cases, it's a lot of the lobbyists from the defense manufacturers have helped write the regulations that shut out competition. You've got younger startups. Anderil is a great example. It's headquartered here Atlanta. Anderil makes drones. Anderil has complained for years about how impossible it is to penetrate the government bureaucracy because of the regulations that are designed by its competitors to shut out innovation. And it's true. Anderil is an incredible company. If I could buy stock in that company, I would. I don't think it's public. It's not publicly traded. I would buy stock in a heartbeat. They make these incredible drones that take off fly. If they don't blow up, they return home and land again so they can be used the next day. All these other companies just make these one-off missiles. They blow up and, hey, government, come buy another one from me.

The defense sector has lacked focus in innovation, and whether the president can do it or not, I'm at least glad he's starting to a saber-rattle against the defense industry. They need a shake-up. They can't build a ship and they can't build a weapon without the government subsidizing the rest of their operation. And then they're paying lavish salaries and they're doing stock buybacks and dividends. No, invest your profits and growing your company. We need you to. So both of the Alaska senators involved. Susan Collins from Maine, Paul from Kentucky, Josh Hawley from Missouri. This is the president's response just posted it. Quote, Republicans should be ashamed of the senators that just voted with Democrats in attempting to take away our powers to fight and defend the United States of America. Susan Collins, Lisa Murkowski, Rand Paul, Josh Hawley, and Todd Young should never be elected to office again. This vote greatly hamper. American self-defense and national security impeding the president's authority as commander-in-chief. In any event, and despite their stupidity, the War Powers Act is unconstitutional, totally violating Article 2 of the Constitution, as all presidents and their departments of justice have determined before me. Nevertheless, a more important Senate vote will be taking place next week on this very subject. That is the president's response to Senators Susan Collins Lisa Murkowski, Paul Josh Hawley, and Young, joining with Democrats on a war powers resolution that will restrict military action in Venezuela without prior congressional authorization. Let's go to the phones. I'm going to begin with Michael. Welcome to the show, sir. How are you? Hey, Eric. Good day. Good show. Just wanted to recap to you to get a legal opinion. But I'll give you the disclaimer. So I'm just thinking on top of my head relative to the ice shooting you mentioned earlier. Here we are once again, as you so eloquently describes the shooting at the Capitol. And there's been others. But now here we are again. Is there a wrongful death case here? I'm not advocating for... the behavior of the woman at all. But as far as accountability towards these talking heads that come out and incite this conduct day in and day out, is there a wrongful death case here? You know, for the talking heads, no. They get freedom of speech to say these things. So it's a very, very nuanced and specific area of law. And now, full disclaimer, I don't practice law anymore, but this actually was an area I practiced in. Unless it is a very specific call to action in a specific situation. You can't get a wrongful death claim against anyone who was just advocating against ICE or drumming up tensions. There may be the attempt of a wrongful death case, a civil case in this situation by the... goods, errors against ice, that's not going to go very far because there are, he's got immunity against the claims and because he was operating under his job. I mean, they may want to try to file something, but it's, it's not going to go anywhere. They can take their chances with the jury, I guess, in Minnesota. But against the individuals, no, it's one of the things I think people, Michael, it's a great question because, you know, there clearly is incendiary rhetoric firing people up.

If a politician tells you, ICE is going to be in this location, you go do whatever you can to stop them, I'll protect you. And someone gets killed. Yes, there's an argument for a suit against that politician because he went beyond reasonable speech to a call to action with a claim of protection. But if the governor stands up as Tim Walz says, these are Gestapo Nazis, and we don't want them here, that's not a call to action to stop them specifically. Now, if he also, if Tim Walz stands up and says, these are Gestapo Nazis and we need to do what we can to resist them, that's not a specific call to action. That is a general statement of resistance. And that's protected by the First Amendment as well. It's got to be a very specific on this date, at this time, in this location, you go to this, I'll protect you. And that hasn't happened here. So there's, no, that's a great question, though. What I fear is going to happen is we're going to have a lot more violence against ICE operatives around the country. And I'm deeply disturbed by the increasingly shrill rhetoric of the left. Generally, they want violence in this country. And it has a lot to do with this progressive postmodern critical theory ideology. We don't talk a lot about critical theory anymore. It kind of faded. with claims that it's being taught, but so much of this is critical theory where you believe you're a victim. Your victimization gives you moral authority, and the way to exert your moral authority is to silence the dominant class of people, the oppressors. You've got to shut them up. And they rely on shouting people down. So Tony DeCouple, who is the new CBS evening news head, they're furious with him for giving equal time to the arguments of the left and the right on January 6th, claiming there is no equal time here. It was something bad. Today he's giving equal time to the supporters of Renee Good and their opposition to ICE. And yet you don't hear people praising him. They're only attacking him because they are trying to discourage him from treating the right fairly. And you're going to keep seeing this from the left attacking him. Why? Because the left has used CBS News for years to, quote unquote, subvert the dominant paradigm, to silence the voices of the oppressor class and elevate the voice of the victims. And CBS has thrown that playbook out. And now they're treating both sides equally and fairly. And well, you can't do that in critical theory. You can't treat both sides equally. So, first of all, let me say that I love your kind of default setting to always look to the Constitution for guidance on, you know, what's happening with society and kind of give that perspective. That is amazing. I've called him before. I'm one of the co-hosts of the Don't Unfriend Me Show. Yeah. And I'm also former, yeah, and I'm also a former Navy.

The reason I'm calling is because it was under the last administration. DOD puts out like these directives, and one of them is called DOD 524.01. It was issued in September of 2024. And on page 13 of that document, not that it negates, but it acts as a supplement to Pasecomitatis. And what it does is it gives instruction on how DOD components are supposed to work with local law enforcement. And because ICE kind of works for DHS and DHS kind of works for DOD, then you can see there's some connective tissue there. So with regard to this Minnesota shooting, it really does call into question not the legality, but it almost endorses the fact that this was justified to some degree. And I'm not saying that like. posse comitatis is completely negated, but it is something that we're supposed to, you know, take into account. And at some point, I would just, I would ask that if you could look into that and give, give everyone your legal opinion on that. Go ahead. It really does, it really does kind of point to a more gray area of where the military is supposed to work with local law enforcement. Yeah, you're right. And I probably do need to dive into that one, Mike. And, you know, in this situation, too, I mean, part of the issue here is Homeland Security is such a massive bureaucracy and has now brought in the Coast Guard is now technically part of Homeland Security. It's not actually part of the military. And it just, you do have this blurt of lines. But the bottom line is, I mean, ICE agents are really competent, good at their job. They've been ordered there to do their job. And when you try to protest and block them and wind up hitting one of the guys with the car, they're armed. And by the way, they've been under assault around the country. So tensions are high. And I'm just, I'm so appalled at the politicians who are feeding the tensions and fanning the flames. You know, kudos to John Fetterman, by the way, who actually stood up and said, we got to tone it down here, people. We're going to get people killed. And how is John Fetterman the voice of reason? And yet he is. By the way, I also have to tell you that they're now attacking the ICE agents for not letting a self-identified physician on the scene attend to Renee Good. There's no policy that allows self-declared physicians. I mean, these people are just making it up. This is a propaganda campaign, and I need to give you this warning, and I want you to take it to heart. For the last two years, the progressive left in this country has run a massive PR operation in defense of Hamas.

claiming a genocide in Gaza. They've whipped progressive activists in this country into a frenzy, and there are people in the mainstream media controlling newsrooms of America, progressive activists and politicians who believe Israel starved millions of people. And now we actually know, and have you even heard it, as the New York Times reported on it, that one of the leading global health care entities that studies famine has come out and said there actually was no famine in Gaza, turns out there was no famine? The pictures that you saw of starving people, many of them were cancer patients. One in particular was a cancer patient who died. But there was a massive propaganda campaign. to lie to you and to progressives, to lie to politicians. It was fed by the American media circulated by socialist groups around the country and around the world, and a lot of people bought into it, and it has stimulated and provoked violence against Israel, violence against Jews around the world. The very same people are now pushing anti-ice propaganda. The same people who push the pro-Hamas propaganda. claiming there was a famine in Gaza and a genocide are now pushing the anti-ice. Now, what happened with the anti-Israel propaganda? A lot of Jews around the world have been shot and killed. The same people are doing the same thing with the same help, but the same reporters of the same media institutions against ICE right now. And you know what it's to do. It's to get ICE agents killed. The left believes the only way to deter what ICE is doing is to start killing ICE agents and people won't want to be ICE agents. I actually got a, somebody reached out to me the other day about Homeland Security and would I do ads for Homeland Security on my radio shows? Like, hell yeah, I do ads for Homeland Security. We need good people to stand up and be good law enforcement agents. The ICE agents in this country are not the bad guys. They're not saints, but they're not monsters either. They're American citizens doing a job. And what is the job that they're doing? They're rounding up illegal aliens that Joe Biden allowed to flood the country. The American people voted. Popular vote went to Donald Trump in large part over this issue. to encourage and allow, enable, and emboldened the deportations of a massive wave of illegal aliens who were flooded into the system. And I would note as well that ICE and Border Patrol are conflated a lot of times, and you talk to the actual experts and they say, ICE has it down. They know where to go, when to go, and who they're getting. Border Patrol casts a broader net. Ice is diligent and deliberate. They are often maligned, and now they're being shot at around the country. It is not a coincidence at all that many of the exact same groups that fanned the flames of anti-Israel, anti-Jewish propaganda in the name of Hamas and claiming they were pro-Ghasa, pro-Palestine.

Are the exact same people fanning the flames against ice right now. And just as they use their propaganda to get Jews around the world killed from Boulder, Colorado to Pam Bondi Beach, Australia, they're trying to get ice agents killed right now. They know exactly what they're doing. It is a propaganda campaign with useful idiots and willing collaborators in the media hoping to get these men and women of ice killed. We should condemn it. As I told you, one of the big media accounts or big, big socialist accounts on social media that pushed out a lot of the Hamas propaganda is now pushing out a picture that appears to show an ice agent pointing a gun at someone. If you actually watch the video of it, it is this man who tried to grab the gun from the ice agent and pulled it towards him. You can actually watch the video and you can see the man try to grab the gun and it pulls it towards him and then he lets go and he's like, oh my God, he's pointing a gun at me. No, you actually in the video pulled the gun towards you. They're showing you the picture of the end result of the guy's hands in the air, not the man actually grabbing the gun and pulling it towards him. The ice agent, by the way, his finger is never on the trigger because he's well trained, but you don't see that. It's a coordinated propaganda campaign. Do not fall for the coordinated propaganda of these people. They are an evil group of people. I'm not talking about democratic activists in particular, but these progressive propagandists who are trying to get people killed, it's evil. They're fanning lies. They're putting people's lives at risk. The other day, progressives were all up in arms because a picture circulated of one of the Cuban mercenaries protecting Maduro, who American forces killed. It was a picture of him with his children. We killed this man. Look at his children. They will never see their father again. Pay no attention to the fact that this man was a mercenary who killed Venezuelans protecting Maduro. Pay no attention to that. It's the same sort of propaganda. pulling the strings, the heartstrings of Americans to whip them into a fury, to delegitimize lawful action, and in the process, fan the flames of violence. And what's so notable is that the very people who are horrified with the American military taking Maduro, a communist, murderous dictator, they're horrified at the president of the United States, using ICE to get rid of... murderers and criminals, gangbangers and drug dealers who are illegal aliens from this country. It appears Venezuela's new leader and her military-backed government were willing to meet American, are willing to meet American demands about oil. The president says he will control the oil supply, sell it, and keep the money in a separate account from the U.S. Treasury that is going to be used for the benefit of the Venezuelan people. But wait, wait, wait, there is more that I find very, very interesting. It appears, where is this line? Yep. Sorry, I'm skimming the article here because I knew the number was, maybe I should say a little. When the Cuban said 32 Cubans were killed, I knew the number was higher. Top ally Havana issued a list of 32 dead Cuban military personnel, many of the members of Maduro security detail. Venezuela's Attorney General Tariq William Saab spoke Tuesday of dozens of civilian military deaths without giving a breakdown. But now there is this, according to the AFP, Venezuela and Cuban-named 55 military personnel. including senior officers, killed during the U.S. raid to seize Maduro. Venezuela's defense minister Vladimir Putin Padreino Lopez said the presidential guard was largely wiped out, quote, unquote, in cold blood. There are even politicians in the United States and outside observers, and even leadership within the American military. who don't understand just how good our special forces are. They just can't believe it. Our special forces went into Venezuela. By the way, one of the helicopters was malfunctioning the whole time, and they still made it work, killed over 60 Cuban security guards. A number of Venezuela's top military leadership in the process extracted Maduro and left without a single American wounded or killed without losing the malfunctioning helicopter. It's an impressive, impressive operation by the American military. And you've got senior American leaders who don't appreciate the capability of the American military. Our soldiers are elite. They are the elite of the elite. For perspective in Syria several years ago, 40 of our American special operators were surrounded by, I think, 2 to 500. I want to say it was 500. It might have been 200, but I think it was 500, Wagner Russian mercenaries. These are members of the Russian military turned mercenaries. Surrounded, 40 of our special operators killed all of the Wagner mercenaries.

Without a single loss of life by the Americans. That's how good we are. That's how good they are. Our military. So impressive. For your business, Vision computers impressive.
